Reporters Without Borders raps censorship of UK comedian's "Borat" website

Reporters Without Borders condemned censorship by 
the Kazakh government, which has removed the 
right to use the .kz suffix (equivalent to .uk) 
from two websites it finds troublesome, including 
that of British comedian Sacha Baron Cohen, or 
"Borat".

The worldwide press freedom organisation said it 
was concerned by the politicisation of the 
administration of domain names and has written to 
Franck Fowlie, ombudsman for the Internet 
Corporation for Assigned Names and Numbers 
(ICANN,) that registers domain names, asking him 
to intervene.

Borat.kz carries sketches by Sacha Baron Cohen, 
who portrays a sexist and racist Kazakh 
journalist on the US cable channel HBO. The 
Kazakh web business body that manages the .kz – 
said the site had been shut because borat.kz was 
hosted outside Kazakhstan and false 
administrators’ names had been given when it was 
registered.

The government decided last month to deny .kz to 
sites hosted abroad, an unjustified step that 
tightens political control over Kazakh online 
publications.

"The role of bodies that manage the country code 
top-level domain names (ccTLDs) is above all 
technical. They are not qualified to censor the 
contents of sites", Reporters Without Borders 
said in its letter to Frank Fowlie. “We find 
however that the Kazakh government sees to it 
that websites that mock or criticise it are 
rejected."

"In this way, it infringes the principles set out 
by ICANN, which requires that the management of 
the ccTLDs should be fair and non 
discriminatory’. We think that an intervention by 
your organisation would show that it was capable 
of defending free expression on the Internet, a 
key issue when you consider the stormy debates on 
the governance of the Internet that marked the 
recent World Summit on the Information Society 
(WSIS)", the letter to the ombudsman said.

The opposition website Navi.kz was forced to give 
up its .kz at the end of October after a legal 
procedure that was stage-managed by the 
authorities.

In November, Reporters Without Borders put 
Kazakhstan on a list of "countries to watch" 
because of repeated violations of free expression 
on the Internet. See:

site de l'humoriste anglais "Borat"

Ces derniers mois, deux sites Internet qui 
dérangent le gouvernement Kazakh, dont celui de 
l'humoriste britannique Sacha Baron Cohen, alias 
"Borat", ont perdu le droit d'utiliser leur .kz - 
l'équivalent du .fr ou .uk pour le Kazakhstan. 
Reporters sans frontières s'inquiète d'une 
politisation de la gestion des noms de domaine et 
dénonce ces actes de censure.

L'organisation a écrit à Franck Fowlie, 
modérateur de l'ICANN, organisme international 
qui supervise l'attribution des noms de domaine 
pays, pour lui demander de se saisir de cette 
affaire. "Les organismes gérant les noms de 
domaine pays (ccTLDs) ont une fonction avant tout 
technique. Ils ne sont pas habilités à censurer 
des sites en raison de leur contenu. Nous 
constatons pourtant que le gouvernement Kazakh 
s'arrange pour refuser le .kz aux sites qui le 
moque ou le critique. Ce faisant, il enfreint les 
principes définis par l'ICANN, qui exige que la 
gestion des ccTLD soit 'juste' et 'non 
discriminatoire'. Nous pensons qu'une 
intervention de votre organisation démontrerait 
qu'elle est apte à défendre la liberté 
d'expression sur Internet, une question 
d'importance au regard des débats houleux sur la 
gouvernance d'Internet  qui se sont déroulés lors 
du récent Sommet sur la société de l'information 
(SMSI)", a déclaré Reporters sans frontières dans 
son courrier.

Le site Borat.kz reprenait les textes d'un 
humoriste anglais, Sacha Baron Cohen, qui 
interprète, dans un show télévisé diffusé sur la 
chaîne américaine HBO, un personnage de 
journaliste kazakh sexiste et raciste. 
L'Association Kazakhe des entreprises du secteur 
d'Internet - organisme en charge de la gestion 
des .kz - a justifié la fermeture du site en 
expliquant que borat.kz était hébergé hors du 
Kazakhstan et que de faux noms d'administrateurs 
avaient été donnés lors de son enregistrement. Le 
gouvernement avait en effet décidé, le mois 
dernier, d'interdire le .kz aux sites hébergés à 
l'étranger. Une mesure non justifiée allant dans 
le sens d'un contrôle politique accru des 
publications en ligne kazakhes.

Fin octobre, le site d'opposition Navi.kz avait 
été contraint d'abandonner son .kz suite à une 
procédure judiciaire manipulée par les autorités.

En novembre, Reporters sans frontières avait 
placé le Kazakhstan sur une liste de "pays à 
surveiller" en raison d'atteintes répétées à la 
liberté d'expression sur Internet. Voir :
