A lawyer arrested for posting an article online

Reporters Without Borders has called for the 
release of lawyer Mohammed Abu who was arrested 
in Tunis on 1st March 2005 for posting an article 
online dealing with the torture of political 
prisoners in Tunisia.

"We would like to remind President Ben Ali that 
he approved the final statement of the last UN 
summit on the Internet (World Summit on the 
Information Society -WSIS) that stipulates that 
freedom of expression is a "essential 
foundation"of the information society. How can he 
boast about having initiated this summit while 
trampling so openly on its founding principles?" 
the worldwide press freedom organisation asked.

Mohammed Abu, a lawyer and human rights activist 
was arrested on the order of an examining 
magistrate at a court in Tunis. He is accused of 
publishing an article on the Tunisnews website in 
August 2004 comparing torture committed against 
political prisoners in Tunisia to abuses carried 
out by US soldiers in Iraq's Abu Ghraib prison. 
He expressed surprise that Tunisian criticism 
only applied to events taking place 2,400 
kilometres away and not to the failings of its 
own regime.

The lawyer was charged, under the press code, for 
"publication of false reports to disturb the 
public order", "insult to the judiciary", 
"incitement to break the laws of the country" and 
"publishing articles to disturb the public 
order." He faces a prison term of up to 10 years.

Abu posted an article on the same site, on 28 
February 2005, about Tunisia's invitation to 
Israeli Prime Minister Ariel Sharon to attend the 
second phase of the WSIS in Tunis. In this 
article, which could also be behind his arrest, 
he made an ironic comparison between Ariel Sharon 
and Ben Ali, whom he said were leaders in the 
same mould.

The lawyer has been held since 2 March in the 9 April Prison in Tunis

Un avocat arrêté pour un article publié sur le Net

L'avocat Mohammed Abou a été arrêté à Tunis, le 
1er mars 2005, pour avoir publié sur Internet un 
article traitant de la torture des prisonniers 
politiques dans son pays. Reporters sans 
frontières demande sa libération.

"Nous souhaitons rappeler au président Ben Ali 
qu'il a approuvé la déclaration finale du dernier 
Sommet onusien sur l'Internet (SMSI), qui stipule 
que la liberté d'expression est un 'fondement 
essentiel' de la société de l'information. 
Comment peut-il se targuer d'être à l'initiative 
de ce sommet tout en bafouant de façon aussi 
manifeste ses principes fondateurs ?", a déclaré 
Reporters sans frontières.

Mohammed Abou, avocat et défenseur des droits de 
l'homme, a été arrêté suite à une décision d'un 
juge d'instruction du tribunal de première 
instance de Tunis. Il est accusé d'avoir publié 
sur le site Tunisnews, en août 2004, un article 
où il comparait les tortures infligées en Tunisie 
à des prisonniers politiques aux exactions de 
soldats américains à Abou Ghraib. Il s'étonnait 
que les critiques des Tunisiens ne portent que 
sur des événements se déroulant "à 2 400 
kilomètres" et pas sur les travers de leur propre 
régime.

L'avocat est inculpé, en vertu du code de la 
presse ainsi que du code pénal, pour "publication 
et diffusion de fausses nouvelles de nature à 
troubler l'ordre public", "outrage à la 
magistrature", "incitation de la population à 
enfreindre les lois du pays" et "publication 
d'écrits de nature à troubler l'ordre public". Il 
encourt une peine pouvant aller jusqu'à 10 ans de 
prison.

Mohammed Abou avait publié sur le même site, le 
28 février 2005, un article concernant 
l'invitation faite au Premier ministre israélien 
Ariel Sharon d'assister à la seconde phase du 
SMSI à Tunis. Dans ce texte, qui pourrait 
également être à l'origine de son arrestation, il 
comparait sur un mode ironique Ariel Sharon et 
Ben Ali, qui sont selon lui des dirigeants du 
même acabit.

L'avocat est détenu depuis le 2 mars à la prison du "9 avril" de Tunis.
