<P class=spip><STRONG class=spip>Paris, le vendredi 9 janvier 2009 - Selon le droit international humanitaire en vigueur, les belligérants doivent tout mettre en œuvre pour assurer la protection des populations civiles. Or, le caractère très particulier des combats, qui se déroulent en ce moment même à Gaza en zone peuplée (voire urbaine) quasi hermétique, et l’ampleur des moyens déployés entrainent de lourdes pertes civiles (25% de civils parmi les blessés selon les Nations unies). La population gazaouite court en permanence un risque vital, y compris les enfants (40% de la population à Gaza selon l’OMS). Face à cette situation, les ONG signataires de ce communiqué* dénoncent le non respect du droit international humanitaire et en appellent à la Communauté internationale pour qu’elle assure la protection des civils. </STRONG>
<P class=spip>L’ampleur des dommages causés aux civils, le non accès aux blessés ainsi que les conditions de vie imposées aux populations à Gaza témoignent du non respect du droit international humanitaire par les belligérants qui ont le devoir d’adapter leurs méthodes de guerre à l’environnement du conflit : aucun d’eux ne doit ni se servir de la population pour protéger des objectifs militaires, ni au contraire faire peser sur la population des attaques non discriminées dans le but de détruire plus largement les moyens de l’adversaire.
<P class=spip>Les restrictions sévères à l’acheminement de l’aide sont en contradiction avec le principe énoncé par le droit international humanitaire de la possibilité pour les organismes de secours impartiaux et indépendants d’accéder aux blessés, malades et civils en situation de vulnérabilité. Le personnel humanitaire étranger est interdit d’entrée à Gaza sauf rares exceptions. Les tirs et la destruction des infrastructures entravent l’accès aux soins. Les civils devraient avoir la possibilité de fuir les combats, ce que la situation à Gaza ne permet pas.
<P class=spip>Les habitants terrorisés sont obligés de se terrer chez eux. L’alimentation et l’eau potable manquent. Les coupures d’électricité, la pénurie de carburants entraînent de graves problèmes pour les pompes à eaux alimentant les réservoirs des immeubles et les générateurs de secours des hôpitaux. Il est impossible de cuisiner ou de se chauffer.
<P class=spip>Les conséquences de l’accès extrêmement insuffisant des secours sont de facto assimilables à une punition collective ou à une action de représailles menées contre la population dans son entier, ce qui est proscrit par le droit.
<P class=spip>Le respect du droit international humanitaire incombe aux deux parties en conflit. Dans le cas où l’attitude des belligérants n’est pas conforme, la communauté internationale a dès lors le devoir d’en assurer la mise en œuvre effective.
<P class=spip>En tant qu’ONG humanitaires, nous en appelons à la communauté internationale pour qu’elle assure la protection des populations civiles. Les passages de camions, sporadiques et non sécurisés, l’arrêt des combats accordé 3 heures par jour, sont largement insuffisants.
<P class=spip>Nous demandons : <BR><IMG height=11 alt=- width=8> l’instauration immédiate d’un cessez le feu qui est la seule solution pour pouvoir secourir les civils ; <BR><IMG height=11 alt=- width=8> qu’il ne soit pas fait entrave à l’accès aux blessés avec les ambulances, à leur brancardage et à leur évacuation vers les hôpitaux ; <BR><IMG height=11 alt=- width=8> que l’accès soit ouvert au personnel humanitaire de manière à ce que l’assistance puisse être acheminée jusqu’aux plus vulnérables, notamment des denrées alimentaires de base, que des médicaments, du matériel chirurgical puissent être délivrés aux hôpitaux et aux dispensaires de quartiers, et que les praticiens palestiniens épuisés puissent être relayés par de nouvelles équipes médico-chirurgicales .
